TERMS AND CONDITIONS

Organiser and Eligibility

The “Lucky Draw Contest” 2023 (“Contest”) is organized by Tera Va Sdn Bhd [201101001113 (929247-P)] (“Organiser”).

By participating in this Contest, you agree to comply with all terms and conditions set forth herein.

1. This Contest is open to all Malaysians who are aged eighteen (18) years old and above (“Contestants”).

2. The following categories of Contestants are NOT ELIGIBLE to participate in this Contest:

a. Permanent/contract employees of the Organiser and/or its Affiliates;

b. The immediate family members (i.e. father, mother, spouses and or child/children) of the Non-Eligible Contestants. “Affiliate” shall mean each of its subsidiaries, holding companies and subsidiaries of such holding companies.

3. The Contest period runs from 1 November 2023 to 31 December 2023.

4. The Organiser reserves the right to terminate, change, amend, delete and or add to these Terms and Conditions at any time without prior notice.

5. The Organiser shall not be held liable for any loss, damage and or expense for any reason(s) whatsoever.

6. The Organiser’s decision shall be final and binding. No correspondence will be entertained.

7. By entering into the Contest and by accepting the prize, all winners agree that the Organiser has the right to photograph, picture, voice record and or portray them as contest winners in any manner whatsoever as the Organiser may in its absolute discretion decide, and to exhibit these materials for all contest-related advertising, marketing and or publicity purpose(s) without any notice, payment, fee, compensation or consideration whatsoever, subject to the applicable laws and regulations.

8. Contestants and winners of the Contest are deemed to consent to the Organiser’s right to use their name, voice, photograph, footage and or the content of their entries solely for the above-mentioned purposes.

How to Participate

1. To participate in the Contest, Contestants are required to:

a. Sign-up (with confirmation deposit) for home solar system during contest period;

b. Fill up form and answer simple question provided by the Organiser

2. The Organiser shall not be held responsible for any Internet connection error that may affect the Contest.

Winners and Prizes

1. The Organiser will draw two (2) grand prize winners and seventy (70) consolation prize winners for each round during contest period as per below details. The announcement of each round will be made on the 5th of the following month. i.e. November winners will be announced on 5th of December 2023 and December winners will be announced on 5th January 2024.

a. Two (2) grand prize winners to win One (1) Apple iPhone 15 each; or

b. Seventy (70) consolation prize winners to win:

i. Ten (10) on-site system health check; or

ii. Twenty (20) online monitoring & reporting (for 3 months); or

iii. Fourty (40) goody bag.

2. The Organiser has the right to change any prize without prior notice,

3. All prizes cannot be transferred or exchanged for cash.

4. The names of all winners will be published on the Organiser’s social media platforms such as Facebook and Instagram.

5. In the event that any Contest entry or prize is awarded to a person who:

a. is not eligible for the Contest; and/or

b. has committed or is suspected of committing any fraudulent or wrongful acts, the Organiser reserves the right to disqualify such person from participating in the Contest and/or from receiving the prize.

7. The Organiser makes no warranties and or representations whatsoever with respect to the prizes and will not be responsible nor liable for any problems and/or damage thereto or arising there from.

8. The Organiser reserves the right to replace the said prize with another prize of equal or lesser value.

9. Contestants hereby irrevocably agree and give their consent to the Organiser to publish any related matter to the entries including and not limited to the Contestants’ names and or interviews and photographs for current and or future advertising and promotional purposes.

10. The Organiser will not be held responsible for any other costs, fees and/or expenses incurred or to be incurred by the winners in relation to the Contest and/or in claiming the prize(s) which are the sole responsibility of the winners.

11. All winners recorded by the Organiser shall be final and conclusive.

Collection of Prizes

1. Winners are required to include the following personal details upon request: name, contact number, postal address and email address. The Organiser and any party acting on the Organiser’s behalf may use such details to communicate with the winners on matters relating to the Contest. Unless required by law, the Organiser will not provide such information to any third party without permission.

2. The Organiser will post / email the prizes by mail / email to the address given by the winners or winners require to redeem the prize at Organiser’s HQ Kota Damansara or Subang Jaya. 

3. The Organiser will not be held responsible for any address changes after the address confirmation by the Contestant.

4. The Organiser will not be responsible for any loss of prizes in transit.

5. The Organiser will not be responsible for other costs, fees and or expenses incurred or to be incurred by the winners in relation to claiming the prize(s) which are at the sole responsibility of the winners.

6. Upon receiving the prizes, the winners are required:

a. To take photographs together with the prizes;

b. To share the photographs with the Organiser via email, or the Organiser’s social media pages, i.e. Facebook or Instagram;

c. To sign a letter of acceptance upon receiving the prizes as an acknowledgement and send the signed digital copy back to the Organiser via email or any digital mode of communication.

7. Payment in full should be completed by the winner before redeem the prize.

8. Winners of the lucky draw contest must redeem their prizes within six (6) months of the official announcement. Failure to redeem he prize within this stipulated period will result in forfeiture, and the organizer reserves the right to retain the prize. The organizer will not be liable for any claims, demands, losses, costs, or expenses incurred by the winner as a result of the forfeiture.

9. The Organiser reserves the right to use the names, addresses, photographs, and testimonies of the Contestants in advertisements and other forms of publicity in conjunction with the Contest. The Contestants’ participation in the Contest and agreement to be bound by the terms and conditions herein shall be deemed to indicate their implied consent to such use, without any notice, payment, fee, compensation, or consideration whatsoever.

Liability

The Organiser will not be responsible or liable for any problem, damage and or loss of whatsoever nature suffered by any Contestant or their authorised representatives resulting from their participation in the Contest, any error (including error in notification of Contest winners), omission, interruption, deletion, defect, delay in operation or transmission, Internet line failure, theft, destruction of, or unauthorised access to entries, system unresponsiveness whether or not arising during operation or transmission as a result of server functions, viruses, bugs or other causes outside its control.

Disqualification

The Organiser reserves the right at its sole discretion to disqualify anyone deemed to be tampering with the entry process or the operation of the Contest, to be acting in breach or potential breach of these Terms and Conditions. No correspondence in relation to the above will be entertained.

Disclaimer

The Organiser receives and processes the Contestant’s personal data in accordance with Organiser’s privacy policy and the Personal Data Protection Act 2010 (PDPA) when the Contestants provide their personal data to the Organiser. The Contestants acknowledge that they have agreed to the Organiser’s terms and conditions upon participation in the Contest by allowing Organiser to collect, use and process the Contestants’ personal data in accordance with the Organiser’s privacy policy and the PDPA for the following purposes:

– Sending the Contestants information related to online promotions, contests and events and related to Organiser’s marketing activities, unless the Contestants have indicated to the Organiser that they do not wish for the Organiser to process their personal data for such purposes;

– Using the Contestants’ information for marketing and statistical analysis for planning and demographical use;

– Complying with local laws and regulatory requirements and or to assist in law enforcement and investigations by relevant authorities;

– Any other purposes related to Organiser’s marketing activities.

DATA PROTECTION AND PRIVACY POLICY NOTICE

The Contestants’ personal data including their names and contact details (“Personal Data”) which they have provided to the Organiser in their application to participate in the Contest will be recorded, stored or otherwise processed by the Organiser for purposes relating to the administration of the Contest and for related advertising, publicity, marketing and the Organiser’s other legitimate business purpose (“Purpose”). Please be informed that the Contestants’ Personal Data may be disclosed to the Organiser’s Affiliates, service providers and relevant business partners such as public relations agencies, market research firms, advertising agencies (if any) for the Purpose and as permitted by applicable data privacy laws.

6. Can I submit more than one entry?

– Yes, you may submit more than one entry. One home solar system installation address per entry.

7. How many times can I win during the entire contest period?

– Each eligible participant is entitled to win only one prize throughout the campaign period from 1 Nov until 31 Dec 2023.

8. What is the basis of winner’s selection?

– The winners must complete all the details and answer question correctly via Microsoft Form and submit contest entry as per below date:
